Welcome to Blue Sky Farewells. By accessing or using our services, you agree to the following Terms and Conditions. Please read them carefully before booking or using any part of our website or services.
1. Services Provided
Blue Sky Farewells offers professional aerial ash scattering services by aircraft. Services may include custom ash scattering over land or water, within approved airspace and regulatory guidelines.
2. Scheduling and Availability
All flights are subject to weather conditions, aircraft availability, and airspace restrictions. All services will be conducted under Visual Flight Rules (VFR). We will make every effort to honor requested dates and times but cannot guarantee specific scheduling until confirmed in writing.
3. Airspace Compliance
We adhere to FAA regulations and applicable federal, state, and local airspace laws. Some locations may be restricted or require adjusted flight paths. Flights over congested areas or certain protected regions may not be permitted.
4. EPA Offshore Requirements
For ocean and shoreline scatterings, we comply with EPA regulations requiring scatterings to occur at least 3 nautical miles offshore. Location requests will be honored as closely as safely and legally possible.
5. Scattering Coordinates
While we make every effort to reach the coordinates provided, factors such as air traffic, weather, and airspace restrictions may cause a 1-mile variance from the exact location. Clients acknowledge and accept this potential deviation.
6. No Formation Flights
For safety reasons, Blue Sky Farewells does not participate in formation flights or coordinated multi-aircraft events.
7. Remains Handling
We treat all cremated remains with the utmost respect and care. Only organic remains will be scattered; any non-organic material (e.g., jewelry, implants, prosthetics) found will be returned to the client when possible. It is the client’s responsibility to ensure remains are properly processed and do not contain prohibited materials.
8. Client Responsibility
By booking with us, the client agrees that they have full legal rights to make decisions about the remains and have secured all necessary permissions. Blue Sky Farewells is not liable for any disputes or claims resulting from unauthorized handling of remains.
9. Cancellations and Refunds
Cancellations must be made at least 72 hours in advance to be eligible for a partial refund. Refunds may be subject to administrative fees. Cancellations due to weather or safety concerns will be rescheduled at no additional cost.
10. Photography, Video, and Media Use
Blue Sky Farewells may capture photos or video during the service for documentation, quality assurance, or promotional use. By booking our services, the client grants Blue Sky Farewells full permission to use any such media — including images or footage of the aircraft, scattering event, and surrounding scenery — on our website, social media platforms, or other marketing materials, unless a written request for exclusion is submitted prior to the service.
Identifying personal details (such as full names or faces, if applicable) will not be published without explicit consent. Clients may request copies of any available media for personal use.
11. Limitation of Liability
Blue Sky Farewells is not responsible for delays, cancellations, or variations due to weather, air traffic control, mechanical issues, or other factors beyond our control. We are not liable for any emotional distress or intangible losses associated with the nature of our services.
12. Privacy
We respect your privacy. Any personal or sensitive information shared with us will be kept confidential and used solely for the purpose of providing services.

13. Shipping and Handling of Remains
All costs associated with the shipping of cremated remains to Blue Sky Farewells are the responsibility of the client. We recommend using a trackable, insured shipping method that complies with USPS or courier regulations for the transport of human remains.
Remains must be received by Blue Sky Farewells at least 72 hours prior to the scheduled service date to allow for preparation and flight planning. Failure to deliver remains within this window may result in rescheduling or cancellation of the service, subject to applicable fees.
If, for any reason, cremated remains must be returned to the client — whether due to cancellation, ineligibility for scattering, or other circumstances — return shipping costs will also be the responsibility of the client. These costs will be deducted from any deposits or payments eligible for refund.
Blue Sky Farewells is not responsible for delays, damage, or loss caused during shipping. Any remains received after the scheduled deadline may be held until an alternative date can be arranged.
14. Changes to Terms
We reserve the right to update or modify these Terms and Conditions at any time without prior notice. Continued use of our services constitutes acceptance of any revised terms.
